Radical Thought

Ok this just popped in my head - one of my doctors has told me that GSK has used tactics to make sure it's drug Paxil gets preferred status with the insurance companies, so it's more expensive to prescribe any other SSRI.

And they know it's addictive, so they know they have life long users.

They send mail to the doctors encouraging them to prescribe it more.

Manipulating an enterprise for profit?

Call me crazy (ok don't cuz I'm not in the mood for it)... but would RICO apply here????

I know, I'm just fantasizing here, but darn that would be an interesting case.

I would think it wouldn't matter anymore. Paxil has gone generic, and in many states, generic MUST be prescribed if its availabe. GSK has no say over the matter anymore, which is why the now have Paxil CR (controlled release) as their next generation Rx. bottom line, i don't see RICO, and besides i don't think RICO would apply, which is criminal, but maybe a fair trade issue
